We reserve the right to reject ANY requests for articles/material we regard as offensive or inappropriate. Things that Need An Article regards as offensive or inappropriate are subjects/topics such as: racism, sexual deviance and or sexually immoral in nature. Examples: Topics on casual sex, seduction, porn, Kamasutra, etc. Exceptions can be made however on some sexual related topics where a medical aspect is involved. Any Topics that are Satanic in nature. Topics condoning substance abuse; illegal drug use. Topics condoning hate. All such subjects are off limits here at Need An Article and will be refused. Other types of requests we refuse to accept are 'home work' assignments from College/High School students looking to outsource their educational responsibilities. Topics that violate current US federal and state laws.

Customer service terms and usage policy

Although Need An Article does posses a valid email address, it is not the primary way we administer customer service. Because email can be 'hit and miss' and unreliable at times; due to the various reasons we can not fully expound on here, we have resorted to using help desk software to offer a more reliable and stable customer service experience. Because this help desk is accessible and available in both the members' and public area of the site, we will require clients to use this channel of communication for any such customer support issues that may arise. Choosing NOT to utilize the help desk does not make us liable or subjugable to scrutiny on the part of someone (Be it client or potential client) who simply does not like to read. So we ask that you use the help desk located in the members' area labeled "Support" and on the main site near the top right under "Questions?". Thank you.

Content Refund policy

Because we have no way of controlling how you use the content you receive back from us, we do not issue refunds, or initiate reassignments on article requests, press release requests, or any type of requests available on the site unless it can absolutely be proven a given writer was unqualified, or negligent in fulfilling a request.

Article credit Refund policy

We have a 30 day article credit return policy. After which, we do not issue refunds on credit purchases. However, because we keep a record of all accounts active and inactive, we do allow inactive accounts to be reactivated and any unused credits to be used for future requests. Plainly stated, transactions initiated on the site will be refunded upon request (Via a support ticket from our help desk) within 30 days of the transaction. Common comments/questions: Why do we have this policy? It seems unfair, or unethical that you keep money after 30 days. Or, I should be able to get my money back anytime I request it. Answer: Need an article is not a bank, nor do we give the impression in anyway shape or form that we are. We expect our subscribers to use discretion and be aware of this policy and only fund their accounts with funds that they will readily use. Also, issuing a refund takes time - especially after 30 days. Because we are an extremely busy site with limited administrative staff, please use discretion and good planning when funding your account. Ignoring, or failure in making yourself aware of the site's policies is not our fault. Please note that the site's terms are posted on the registration page, and on every page of the site near the footer under a link labeled "Terms of use agreement".

Membership fee refund policy and payments disclaimer

Upon non usage of NAA's service, membership/subscription fees are only refundable 7 days after joining Need An Article. Also, we are not obligated to honor membership fee refund requests on accounts that fail to cancel between billing periods. Simply stated, if you cancel your account during any month, other than your initial month, asking for refund will not be honored. In addition, Need an article's payment gateway is based around using Paypal™ and it's subscription mechanism and we are not responsible for issues and occurrences that pertain to a user's Paypal™ account. Fraudulent account usage

Anyone, be it client, writer, contractor/non employee, who attempts to defraud D.B.A. Need-An-Article.com by using our services with the intent to mislead, or circumvent the site in anyway, will be treated as malicious activity and we could initiate legal recourse against you. Things we regard as malicious activity: Stealing content, disregarding/ignoring site rules and policies, funds reversals/charebacks on completed/delivered content. Simply stated, if you use our services and attempt a funds reversal on content that you have already received via the site interface we reserve the right to initiate legal recourse against you for damages caused. Also, because we have a full support team to handle client issues, we will require that you use this provided channel in order to make us aware of any issues you may have. By-passing this requirement and attempting a funds reversal of any kind will be treated as fraud. Hint: make it easy and use the Help desk - we are there to help.

Content request policy

By submitting a request for service at Need-An-Article.com/net, you agree to abide by our stated rules, examples, outlines and guidelines posted on the site. Failure to follow these rules, examples, outlines and guidelines we have offered on HOW to make a suitable request for service, does not make us liable for any recourse. Plainly stated, if your requests don't outline well enough what you are wanting, or if you require additional services above the scope of our guidelines then we have the right to require re editing consisting of upgrades/additional credits or funds. This also applies if you decide to revamp or add to a given request and require further research, writing or editing, etc.

Site Abuse policy

You are responsible for your own personal conduct on our site. Any behavior that is offensive or malicious in nature will not be tolerated. We reserve the right to terminate ANY account, be it writer or client, who abuses this policy. Acts that we regard as offensive: Critical or Abusive language/comments in private messages, feedback ratings, One time changes and entry forms. Inappropriate use of the feedback system. Any attempt to deliberately tarnish anyone's image via feedback ratings will not be tolerated and will be subject to termination of their account. Soliciting writers to do work outside of the site for anything, including bartering deals is off-limits. Asking writers to write in an intentional dishonest manner for any reason.

Disruption of service policy

Anyone, be it client, writer, contractor/non employee, etc. who attempts or causes disruptions in the normal flow of service at Need-An-Article.com/net, can be subject to cancellation as well as loss of pay, including pay on completed/non completed article requests, bonuses and credits. Such things we regard as disruption of service are the following: Unnecessary/unreasonable support ticket requests, PM messages, OTC's. For writers: Carelessness/sloppiness in work duties. Disregarding or ignoring of requests such as PMs, OTC's service/work instructions provided by site admin, clients, proof readers, programmers. Plagiarism/Copyright violations. Writers are expected to complete a minimum of at least four articles as a part-timer and six articles a week as a full-timer. When work exceeds the designated time frame, status reports must be submitted and client contact must be made unless administration approved arrangements are made.

Copyrights and ownership Policy

All content that you receive back as a result of using Need-an-article.com, becomes your copyrighted material. Furthermore, it is the sole responsibility of each client to signify that they are the legal copyright holder of any and all material they receive back from us. We are not responsible for issuing documentation other than what we have stated here in our policies. Moreover, as stated above in the Fraudulent account usage section, any attempt to defraud Need An Article through funds reversals, or charge-backs on any finished content, nullifies the individual's right right to obtain a copyright on the given material received from us.

Confidentiality / Non compete agreement

I will not, directly or indirectly, use, make available, sell, disclose or otherwise communicate to ANY third party, other than in my assigned usage and for the benefit of the Company, any of Need-an-article.com's /net Confidential Information, either during or after my involvement with the Company. I agree not to publish, disclose or otherwise disseminate such information without prior written approval of the President of the Company. I acknowledge that I am aware that the unauthorized disclosure of Confidential Information of the Company may be highly prejudicial to its interests, an invasion of privacy, and an improper disclosure of trade secrets.

In keeping with Need An Article's non compete agreement, I hereby give consent that upon my stay, resignation or termination of my account at Need An Article, I will not attempt to compete in anyway shape or form with Need An Article. Upon resignation or termination of my account, the required duration of this non compete agreement is binding for 12 calender months and I agree to be bound by it. I understand that any violation of this agreement may result in some form of legal recourse and we will excercise all punitive measures that the law grants. Definition of a competitor: Any type of membership based site that offers writing services whether through an automated or manual means. We regard any such sites as direct competitors of Need An Article. [End]

WE ARE NOT LIABLE EVEN IF WE'VE BEEN NEGLIGENT OR IF OUR AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR BOTH.
EXCEPTION: CERTAIN STATE LAWS MAY NOT ALLOW US TO LIMIT OR EXCLUDE LIABILITY FOR THESE "INCIDENTAL" OR "CONSEQUENTIAL" DAMAGES. IF YOU LIVE IN ONE OF THOSE STATES, THE ABOVE LIMITATION OBVIOUSLY WOULD NOT APPLY WHICH WOULD MEAN THAT YOU MIGHT HAVE THE RIGHT TO RECOVER THESE TYPES OF DAMAGES.

If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Boise. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.
If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Boise, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
Need-an-article.com/net may modify these Terms of Use, and the agreement they create, at any time, simply by updating this posting and without notice to you. This is the ENTIRE agreement regarding all the matters that have been discussed.
